1. Acceptance of Terms

By accessing our website, enrolling in our courses, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access or use our services.

You must be at least 16 years old to access or use our services. By accessing or using our services, you represent and warrant that you are at least 16 years old. If you are under 18 years old, you represent that you have your parent or guardian's permission to access or use our services, and they have read and agree to these Terms on your behalf.

2. Account Responsibilities

Account Creation

To access certain features of our services, you may be required to create an account. When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

Account Security

You agree to accept responsibility for all activities that occur under your account or password. You should immediately notify us of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

Account Information

You agree to provide and maintain accurate, current, and complete information about yourself. We will handle your information in accordance with our Privacy Policy.

3. Course Enrollment and Payment

Enrollment

By enrolling in an Incrospici course or program, you agree to pay all fees associated with the course or program. Enrollment is subject to availability and may be subject to additional terms specific to the course or program.

Fees and Payment

All fees are quoted in Canadian Dollars (CAD) unless otherwise stated. Payment must be made using one of our accepted payment methods. You agree to provide current, complete, and accurate purchase and account information for all purchases made through our services.

Taxes

Fees do not include any taxes, levies, duties, or similar governmental assessments, including value-added, sales, use, or withholding taxes, assessable by any jurisdiction (collectively, "Taxes"). You are responsible for paying all Taxes associated with your purchases.

Automatic Renewal

If you enroll in a subscription-based service, your subscription will automatically renew for the same interval of time as the original subscription period, at the then-current rate, unless you cancel before the end of the current subscription period.

4. Intellectual Property Rights

Incrospici Content

Our services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Incrospici, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for your personal, non-commercial use. This license does not include any resale or commercial use of our services or their contents; any collection and use of any product listings, descriptions, or prices; any derivative use of our services or their contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Restrictions

You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as permitted by these Terms.
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from our services.
• Access or use for any commercial purposes any part of our services or any services or materials available through our services.

Trademarks

The Incrospici name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Incrospici or its affiliates or licensors. You may not use such marks without the prior written permission of Incrospici.

5. User Content

Definition

"User Content" means any content, material, or information, such as comments, reviews, or feedback, that you submit, post, or display on or through our services.

Ownership

You retain all ownership rights in your User Content. However, by submitting User Content to Incrospici, you grant Incrospici a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with our services and Incrospici's business, including without limitation for promoting and redistributing part or all of our services.

Representations and Warranties

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize Incrospici to use your User Content as described in these Terms.
• Your User Content does not violate the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
• Your User Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
• Your User Content does not promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Your User Content does not violate any applicable law or regulation.

Monitoring and Enforcement

We have the right, but not the obligation, to:

• Remove or refuse to post any User Content for any or no reason in our sole discretion.
• Take any action with respect to any User Content that we deem necessary or appropriate in our sole discretion, including if we believe that such User Content violates these Terms, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of our services or the public, or could create liability for Incrospici.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of our services.

6. Prohibited Activities

You agree not to use our services:

• In any way that violates any applicable federal, provincial, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Incrospici, an Incrospici employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our services, or which, as determined by us, may harm Incrospici or users of our services or expose them to liability.

Additionally, you agree not to:

• Use our services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of our services.
• Use any robot, spider, or other automatic device, process, or means to access our services for any purpose, including monitoring or copying any of the material on our services.
• Use any manual process to monitor or copy any of the material on our services or for any other unauthorized purpose without our prior written consent.
• Use any device, software, or routine that interferes with the proper working of our services.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our services, the server on which our services are stored, or any server, computer, or database connected to our services.
• Attack our services via a denial-of-service attack or a distributed denial-of-service attack.
• Otherwise attempt to interfere with the proper working of our services.

7. Cancellation and Refunds

Course Cancellation

You may cancel your enrollment in a course by contacting us at the email address provided in the "Contact Information" section. Cancellation terms vary depending on the specific course or program:

• For group courses, cancellations made at least 14 days before the start date will receive a full refund minus a $50 administrative fee.
• Cancellations made between 13 and 7 days before the start date will receive a 50% refund.
• Cancellations made less than 7 days before the start date are not eligible for a refund but may be eligible for a credit toward a future course.

Subscription Cancellation

You may cancel a subscription service at any time by contacting us or through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period. We do not provide refunds for the unused portion of your subscription period.

Course Rescheduling

If you need to reschedule your participation in a course, please contact us as soon as possible. Rescheduling may be subject to availability and additional fees.

Course Cancellation by Incrospici

Incrospici reserves the right to cancel or reschedule courses due to insufficient enrollment, instructor illness, or other circumstances. In such cases, we will offer you the option to transfer to another course, receive a credit, or receive a full refund.

8. Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR OWN RISK. OUR SERVICES AND ALL CONTENT AND ITEMS OBTAINED THROUGH OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

NEITHER INCROSPICI NOR ANY PERSON ASSOCIATED WITH INCROSPICI MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF OUR SERVICES.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

9. Limitation of Liability

IN NO EVENT WILL INCROSPICI, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON OUR SERVICES OR SUCH OTHER WEBSITES, OR ANY SERVICES OR ITEMS OBTAINED THROUGH OUR SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless Incrospici, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services, including, but not limited to, your User Content, any use of our services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from our services.

11. Term and Termination

These Terms shall remain in full force and effect while you use our services.

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use our services will immediately cease. If you wish to terminate your account, you may simply discontinue using our services or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them.

Your continued use of our services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

13. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or our services shall be instituted exclusively in the courts of the Province of Ontario, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
